1. Agreement to Terms

By installing the CaptureKit Chrome extension, visiting https://capturekit.online, or purchasing any CaptureKit plan, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not install the extension or use our services.

These Terms apply to all users including free users, Pro subscribers, and Lifetime plan holders.

2. What CaptureKit Is

CaptureKit is a Chrome browser extension that allows you to:

Capture screenshots of webpages
Beautify screenshots with gradients, shadows, and padding
Annotate screenshots with pins, arrows, and shapes
Export screenshots as PNG, JPG, or PDF

CaptureKit processes all screenshots locally on your device. We do not store, access, or process your screenshots on our servers.

3. Eligibility

You must be at least 13 years old to use CaptureKit. By using CaptureKit you confirm that you meet this requirement.

If you are using CaptureKit on behalf of a company or organisation, you confirm you have authority to bind that entity to these Terms.

4. Plans and Pricing

4.1 Free Plan

The Free plan is available to all users without payment or account creation. Free plan features include core capture and basic beautification tools as described on https://capturekit.online/pricing. We reserve the right to modify Free plan features at any time.

4.2 Lifetime Plan

The Lifetime plan is a one-time payment of $39 (or the price shown at time of purchase) that grants you permanent access to all Pro features as described at time of purchase.

What "Lifetime" means:

Lifetime refers to the lifetime of the CaptureKit product, not your personal lifetime
You will not be charged again for access to features included at time of purchase
New major features released after your purchase may or may not be included at our discretion
If CaptureKit is discontinued, your Lifetime access ends with the product

4.3 Future Pricing

After the launch period, CaptureKit Pro will be available as a yearly subscription at $59/year. Users who purchased the Lifetime plan during the launch period are not affected by this change.

4.4 Price Changes

We reserve the right to change pricing at any time. Price changes do not affect existing Lifetime plan holders or active annual subscribers during their current billing period.

5. Payments and Refunds

5.1 Payment Processing

All payments are processed by DodoPayments. CaptureKit does not store your payment card details. By making a purchase you agree to DodoPayments' terms and privacy policy at https://dodopayments.com.

5.2 Refund Policy

We offer a 14-day money-back guarantee on all paid plans. If you are not satisfied for any reason, email support@capturekit.online within 14 days of purchase and we will issue a full refund.

No refunds are issued after 14 days from the date of purchase.

5.3 Chargebacks

If you initiate a chargeback without first contacting us for a refund, we reserve the right to permanently suspend your account.

6. Account and Authentication

6.1 Account Creation

An account is only required to activate Pro or Lifetime features. You sign in using Google OAuth via your existing Google account.

6.2 Account Responsibility

You are responsible for maintaining the security of your Google account. CaptureKit is not liable for any loss resulting from unauthorised access to your account.

6.3 One Account Per License

A Lifetime or Pro license is for a single user. You may not share your login credentials with others or use a single license across multiple users.

6.4 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. If we terminate your account for a reason other than a Terms violation, we will issue a pro-rated refund where applicable.

7. Acceptable Use

7.1 Permitted Use

You may use CaptureKit to:

Capture screenshots of webpages for personal, professional, or commercial purposes
Beautify and annotate screenshots for sharing
Export screenshots for use in your work, social media, presentations, or documents

7.2 Prohibited Use

You may not use CaptureKit to:

Capture, distribute, or use screenshots in ways that violate applicable laws or regulations
Capture content that infringes the intellectual property rights of others
Capture private or confidential information without authorisation
Circumvent, disable, or interfere with security features of any website
Attempt to reverse engineer, decompile, or extract the source code of the extension
Resell, sublicense, or redistribute CaptureKit or any part of it
Use CaptureKit to capture or distribute content that is illegal, harmful, defamatory, obscene, or violates third-party rights
Automate use of the extension in ways not intended by its design

7.3 Your Responsibility

You are solely responsible for the content you capture, annotate, and share using CaptureKit. We are not responsible for how you use your screenshots or what content they contain.

8. Intellectual Property

8.1 CaptureKit Ownership

CaptureKit, including its code, design, branding, and all related intellectual property, is owned by CaptureKit and protected by applicable intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use CaptureKit for your personal or commercial purposes in accordance with these Terms.

This license does not allow you to:

Copy or modify the extension
Distribute or sell the extension
Use the CaptureKit name or branding without our written permission

8.3 Your Content

You retain full ownership of all screenshots, annotations, and content you create using CaptureKit. We claim no rights over your content. We do not access, store, or use your screenshots in any way.

9. Third-Party Services

CaptureKit integrates with the following third-party services. Your use of these services is governed by their respective terms:

We are not responsible for the availability, accuracy, or practices of any third-party service.

10. Disclaimers

10.1 No Warranty

CaptureKit is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Fitness for a particular purpose
Uninterrupted or error-free operation
Accuracy or reliability of results

10.2 Website Compatibility

CaptureKit captures screenshots of webpages as rendered in your Chrome browser. We do not guarantee accurate capture of all websites, including those with complex layouts, heavy JavaScript, or security restrictions.

10.3 Third-Party Websites

The content of websites you capture using CaptureKit is entirely outside our control. We are not responsible for the content, accuracy, or legality of any third-party website.

11. Limitation of Liability

To the maximum extent permitted by law:

CaptureKit's total liability to you for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim
We are not liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, or goodwill
We are not liable for any damages arising from:
- Your inability to use CaptureKit
- Unauthorised access to your account
- Content captured or shared using CaptureKit
- Interruptions or bugs in the service

Some jurisdictions do not allow limitation of liability for certain damages. In such cases our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold CaptureKit, its owners, employees, and contractors harmless from any claims, losses, damages, or expenses (including legal fees) arising from:

Your use of CaptureKit
Your violation of these Terms
Your violation of any third-party rights
Content you capture, annotate, or share

13. Service Availability

13.1 Uptime

We aim to keep CaptureKit available at all times but do not guarantee uninterrupted availability. The free plan has no SLA. Pro and Lifetime users may contact support if experiencing persistent issues.

13.2 Changes to the Service

We reserve the right to:

Modify, add, or remove features at any time
Update the extension with or without notice
Discontinue the service with 30 days notice to registered users

13.3 Discontinuation

If we discontinue CaptureKit permanently, we will:

Notify all registered users by email at least 30 days in advance
Issue pro-rated refunds to active annual subscribers
Lifetime plan holders will not receive refunds beyond the 14-day refund window

14. Privacy

Your privacy is important to us. Our Privacy Policy at https://capturekit.online/privacy explains how we collect, use, and protect your information. By using CaptureKit you agree to our Privacy Policy, which is incorporated into these Terms by reference.

Free users: no personal data collected
Pro/Lifetime users: email only
Screenshots: processed locally, never uploaded
No selling of data to third parties

15. Children

CaptureKit is not intended for use by children under 13. We do not knowingly collect information from children under 13. If you are a parent or guardian and believe your child has used CaptureKit, contact us at support@capturekit.online.

16. Governing Law

These Terms are governed by the laws of India.

Any disputes arising from these Terms or your use of CaptureKit shall be subject to the exclusive jurisdiction of the courts of India.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to These Terms

We may update these Terms at any time. When we do:

We will update the "Last Updated" date
We will post the updated Terms at https://capturekit.online/terms

Continued use of CaptureKit after changes are posted means you accept the updated Terms. For material changes we will notify registered users by email where possible.
